Ekosida dalam Yurisdiksi International Criminal Court: Studi Pustaka Kasus Israel-Palestina

Abstract


Penelitian ini menganalisis kewenangan International Criminal Court (ICC) dalam menangani kejahatan ekosida pada konflik Israel-Palestina, dengan fokus pada kerusakan ekologis di Gaza. Melalui pendekatan kualitatif penelitian ini melakukan analisis yuridis normatif terhadap Statuta Roma Pasal 8(2)(b)(iv), mengkaji potensi pertanggungjawaban hukum atas kerusakan lingkungan. Data diperoleh dari laporan resmi dan sumber sekunder terkait dampak ekologis operasi militer Israel. Hasil penelitian menunjukkan bahwa Konflik di Gaza telah menyebabkan kerusakan lingkungan parah yang memenuhi unsur kerusakan dalam Statuta Roma. Namun, kesulitan pembuktian dan kompleksitas politik memperlemah penegakan hukum. Penelitian menyimpulkan bahwa diperlukan amandemen Statuta Roma untuk memperjelas pertanggungjawaban pelaku kejahatan lingkungan, serta penguatan hukum internasional dan sinergi antara keadilan lingkungan dengan hak asasi manusia.
